BATON ROUGE — District Attorney Hillar Moore said he plans to sign a death warrant for convicted killer Todd Wessinger after a federal appeals court denied his request to rehear an appeal of his murder conviction from the 1990s.

Moore said that he intends to sign the warrant, a legal order that would set the date, time and location for the state to execute a death-row inmate. He said he wants to "move forward the jury's decision for the death penalty" for Wessinger.

If a judge signs off on the warrant, an execution will be scheduled.

Wessinger was found guilty of shooting and killing two of his former co-workers at a Baton Rouge restaurant in 1995, and sentenced to death. He has been incarcerated at the Louisiana State Penitentiary at Angola since his conviction.

For the past 30 years, Wessinger has made several appeals to have his death sentence overturned. Most recently, he was denied a request to be taken off death row by the Fifth Circuit U.S. Court of Appeals in August.

His request for a rehearing in this appeal was denied on Monday.

In September, Wessinger also sued Louisiana to halt his execution by way of nitrogen gas asphyxiation, arguing that this method constitutes cruel and unusual punishment.
